Instructing Solicitors agree to treat all information supplied as confidential and not to disclose it without written consent.

I will treat all information and materials of a confidential nature which I receive or create as a result of this Appointment as confidential, (except insofar as I have to refer to them when setting out the substance of my instructions in your report or as required by law).

I will process personal and sensitive data provided by the instructing party in compliance with the General Data Protection Regulation (GDPR) and other relevant data protection laws. All information received will be kept confidential and used solely for the purpose of the medico-legal report, unless otherwise required by law.

All medical records will be stored securely as per the requirements of the Data Protection Act.

The Instructing Solicitor will confirm in writing, details of all parties who have some limited involvement in this matter including Counsel and solicitors and other experts already instructed in this case. I confirm that I do not have an actual or potential conflict of interest in accepting this Appointment in respect of any parties so named and that I will let you know without delay if I become aware of such a conflict.

Email correspondence, in which case files containing sensitive personal data are encrypted and password protected. Passwords are provided separately to receiving parties.

Electronic documents are stored in computers which are protected by a password at log-in, and by regularly maintained antivirus and firewall software. The data is stored within an encrypted section of the hard drive that is protected by a further password. The encrypted sections of each hard drive are synchronised with each other via a cloud service, which also stores a copy of each file on remote servers which are located within the UK in data centres that meet the ISO 27001 standard. The data is fully encrypted in transmission as well as in storage. If local data loss occurs, files can be restored from the remote servers.

Photocopies or original health records are stored until either:

I am informed by the instructing legal team that the matter has concluded or;

For six months from the date of completion of the medical report whichever is sooner.

Original medical records will be returned to the solicitor via recorded delivery.

Photocopies of medical records will be securely destroyed.

Documents that are created by me during my processing of the data, for example letters and reports, are stored for six years from the date that the last document on file was created.

A copy of the completed report will be securely retained by the Expert Witness for six years.

Instructing parties confirm that they have shared a copy of my data protection notice with any and all data subjects about whom they intend to send me personal data.
